What do you do?
Most Sailors (Navy), Soldiers (Army, National Guard), Marines, Airman (Air Force, Air National Guard), and Coastguardsmen (Coast Guard) have one of two responses when confronted with a positive military drug test result. Both responses normally hurt the member's chances of staying in the military.

There is no way to talk your way out of a positive drug test. I repeat. There is no way to talk your way out of a positive drug test. There are many reasons you can’t talk your way out of it, but the easiest one to explain is that your DOD ID# is now tied to a positive drug test at a much higher level than your command. Those personnel and human resources weenies are waiting to hear what your command did about it. And believe me, your commander is not going to put his promotion on the line to say that he believes you when you say you didn’t do it.
Here is what happens when you try to talk your way out of it. You give some terrible story, often that you got really drunk and were hanging out with some people you didn’t know. If I put my prosecutor hat on, you just admitted that you got really drunk. You know what people do when they get really drunk? They make bad decisions – like using drugs! Oh, it was my wife’s prescription. I took it back accident! You now how often that one works? Even with a skilled lawyer, it’s an uphill battle. And, you just told the military you DID use the drug you tested positive for!

Even if you did do drugs, don’t ever admit it unless you have spoken to an experienced military law attorney. The drug screening laboratories get the testing right most of the time, but that doesn’t mean you have to admit drug use! You are entitled to due process and you have rights – like not making a statement! The military will have to prove you knowingly and wrongfully used drugs. That is not the easiest thing to do if they only have a urinalysis result with no statements by the person. And with the right lawyer, your chances are pretty good to stay in the military.
